1. INTRODUCTION AND ACCEPTANCE

1.1. The Platform

These Terms of Service ("Terms") govern your use of the Onssalself.online digital platform (the "Platform"), owned and operated by Self Trade Networks PTY (Ltd.) ("the Company").

1.2. Acceptance

By registering on the Platform, purchasing Lead Access Tokens, or uploading Lead Data, you agree to be bound by these Terms.

1.3. Nature of Platform

The Platform functions solely as a technological intermediary and marketing marketplace that connects independent lead generators ("Contractors") with independent service providers ("Purchasers").

2. DEFINITIONS AND INTERPRETATION

To ensure compliance with the Banks Act 94 of 1990 and the Labour Relations Act 66 of 1995, the following terms apply:

2.1. "Independent Contractor" (Sales Rep)

A user who generates and uploads Lead Data. This user is an independent entrepreneur and not an employee of the Company.

2.2. "Independent Purchaser" (Service Provider)

A user (e.g., electrician, plumber) who purchases access to Lead Data.

2.3. "Lead Access Token"

A digital unit of value purchased in advance, representing a license to view specific Lead Data or utilise Platform features. This constitutes a pre-payment for services and not a financial deposit.

2.4. "Service Credit Ledger"

The digital record of (a) pre-paid Tokens held by a Purchaser or (b) Success Fees earned by a Contractor. This is a record of commercial value exchanged, not a bank account.

2.5. "Success Fee"

The variable amount allocated to a Contractor by a Purchaser upon the successful conversion of a Lead.

3. INDEPENDENT CONTRACTOR STATUS (NO EMPLOYMENT)

3.1. Relationship

You acknowledge that your use of the Platform is in the capacity of an independent business entity. Nothing in these Terms creates a partnership, agency, or employment relationship as defined in Section 213 of the Labour Relations Act or Section 1 of the Basic Conditions of Employment Act.

3.2. Operational Freedom

To explicitly rebut the presumption of employment under Section 200A of the LRA, you agree that:

You are not entitled to annual leave, sick leave, UIF, or severance pay.

4. FINANCIAL TERMS: TOKENS AND LEDGERS

4.1. Purchase of Tokens (Not a Deposit)

4.2. Variable Success Fees

4.3. Payout Requests (Settlement)

4.4. Set-Off Authority

4.4.1. The Company reserves the right to apply Set-Off against any positive balance in a user's Service Credit Ledger to settle outstanding invoices for subscription services (e.g., Region Unlocking).

5. USER OBLIGATIONS AND CONDUCT

5.1. Lead Quality

Contractors warrant that all Lead Data uploaded is accurate, verified, and obtained with the consent of the data subject in compliance with the Protection of Personal Information Act (POPIA).

5.2. No Fraud

The submission of fake, duplicated, or manufactured Leads constitutes material breach of contract and fraud. The Company reserves the right to report such conduct to the South African Police Service.

5.3. Tax Compliance

Users are solely responsible for declaring their income to SARS. The Company will not deduct PAYE or UIF.

6. LIMITATION OF LIABILITY

6.1. No Guarantee of Income

The Company makes no representations regarding the potential income a Contractor may earn or the conversion rate of Leads for Purchasers.

6.2. Platform Availability

The Company does not guarantee uninterrupted access to the Platform and is not liable for losses resulting from technical downtime.

6.3. Indemnity

Users indemnify the Company against any claims, losses, or damages arising from their use of the Platform or disputes between Contractors and Purchasers.

7. TERMINATION AND DEACTIVATION

7.1. Voluntary Termination

You may terminate your use of the Platform at any time.

7.2. Commercial Deactivation

The Company reserves the right to deactivate a user’s account for breach of these Terms, including consistent submission of poor-quality Leads. This constitutes the termination of a commercial vendor agreement, not a dismissal under the Labour Relations Act.

8. GENERAL

8.1. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

8.2. Amendments

The Company reserves the right to amend these Terms. Continued use of the Platform constitutes acceptance of such amendments.
